Learning Team Deliverable Essay

This week we learned that industries consist of all firms making similar or identical products. Their market structure depends on the number of firms in the industry and the ways in which they compete. Our text discussed four basic market structures. The first market structure is perfect competition. Perfect competition occurs when numerous small firms are in competition with each other. Businesses in a competitive industry produce the socially optimal output level at the absolute minimal possible cost per unit. Another type of market structure is known as a monopoly. This is an easy enough concept to comprehend, but I went back and forth with a few classmates as to different examples of a monopoly. Technically, a monopoly is a business that basically has no competitors in its industry. They reduce output to drive up prices and increase profit. In doing so, they produce less than the socially optimal output level and produces at higher cost than competitive businesses. One example of a monopoly would be the existence of only one option in utilities in any particular region. The third type of market structure is known as an oligopoly. This is a type of industry that has very few firms, and if they collude they can reduce output and drive up profits much like a monopoly does. This doesn’t always work though because a lot of times businesses will not honor their agreement with their competing industries. This will make the firms end up competing against each other for consumers business. An example of this type of structure would be the airline industry. This type of situation often benefits consumers. The fourth type of market structure is a monopolistic competition. In this type of structure industries have slightly different products, but still compete against one another. One example of this would be restaurants, and how they all serve food, but different types and at different prices in different locations. Consumers also benefit from the varieties in this type of market  structure. How do markets evaluate the effectiveness of competitive strategies in their structures? For example they do so by evaluating their products, and differentiating their products to survive in the long run. The main way to evaluate the effectiveness is to check the bottom line. The goal of every business is to make money, so an increase in profits will let you know your strategies are effective. Profit maximization is a subject that I personally found a bit intimidating. Profit maximization is the process of obtaining the highest possible level of profit through the production and sale of goods and services. This assumption is the guiding principle underlying production by a firm. In a perfect competition structure, it can be tough to maximize profits. A monopoly has free range to do as they will and therefore it is easier to maximize profits. In an oligopoly market very forms of collusion can reduce competition and lead to higher cost for consumers and higher profits for themselves. Strategic planning by oligopolists must take into account the likely responses of the other firms in their market. In a monopolistic structure the firm maximizes its profits by equating marginal cost with marginal revenue. The intersection of the marginal cost and marginal revenue curves determines the firm equilibrium. The behavior of a monopolistic structure and a monopoly structure appear to be quite similar, especially in the short run. In summary, week 3 was a week packed with interesting conversations started by discussion questions. We are still in a bit of a haze when it comes to economic in general, but are clinging on to hope that we have enough of an understanding to be successful. Research and studying is the key, making yourself more familiar with the terms and their meanings.

In No. 1, concerns are expressed about Pinnacle’s Solar-Electro Division. No. 9 identifies restrictive covenants. The requirements are to keep the current ratio above 2.0 and the debt-to-equity below 1.0. In Part I, the calculation of the current ratio fell below the requirement and thus the need for the loan. Management Integrity In No. 8 there is a significant turnover amongst higher-level positions. This turnover is possibly intentional and thus a greater chance for fraudulent activities. 2. No.1 – The acceptable audit risk is Medium. The auditor would have to prove that the articles are material. No. 6 – Pinnacle Manufacturing is a risky client and the auditors should check and verify each account. The acceptable audit risk is assessed as low. No. 8 – Management is  changing its internal audit team. New members would learn the company and the way the audits are done. The audit risk is low because auditors would not rely on management representation. No. 9 – Because the current ratio and debt-to-equity ratio are below the requirements management will constantly check to either increase or decrease current assets to meet criteria. Thus the audit risk is low.

In many organizations today people working by themselves in achieving the overall objectives of the organization cannot accomplish certain goals and usually require people to work together with others due to its complexity, interrelatedness and the voluminous of the tasks undertaken. In fostering    there is no one individual who owns a work area or process all by themselves, people should be open and receptive to ideas and input from others in the TEAM. The values of teamwork should be shared among the members of the team while compensation and rewards should depend on collaborative practices as much as individual contribution and achievement. It is important to identify â€Å"† and thereby set a benchmark to the rest of the teams. However before embarking on   conflicts of all kinds should be resolved within the organization. Apart from the required technical expertise, a variety of social skills are essential for success in a culture. The Forming-Storming-Norming-Performing model (Bruce Tuckman, 1965) takes the team through four stages of TEAM development. These phases are essential and inevitable in order for the team to grow, to face up to challenges, to tackle problems, to find solutions, plan the work effectively and deliver the end results. However there is a need to establish and develop collaboration and trust between team members vis a vis interactive exercises, team assessments which will enable teams to cultivate effective team building strengths amongst each other. Modern society and culture continues to become more dynamic and the factors contributing towards this include the communications revolution, the global market, specialization and division of labor. Thereby individuals are now required to work with many different groups of people in their working environment and also the personal lives. Successful   that creates effective, focused work teams requires attention to the following areas mentioned in Figure A. Figure A Empowerment is the process of giving an opportunity or authorizing an individual to take decisions, think creatively and have a control of his/her duties in an organization. It is the responsibility on the organization to create a work environment, which helps the desire of employees to act in empowered ways. Top management of organizations has a very important role to play in making employee empowerment successful. Initially the managers need to understand what empowerment really means; and thereby establish boundaries for empowerment, in the event of the managers absence, the decisions that could be made by staff members should be clearly defined; Managers should also build faith and trust on their decisions made by their employees; further managers should coach, train and provide necessary information and learning opportunities for staff to make effective decisions. They should tackle situations wisely and not blame or punish their staff for minute mistakes to avoid employees flee from empowerment, The organizations should ensure that they remove barriers that limit the ability of staff to act in empowered ways. Employees should be motivated in terms of compensation, recognition and responsibility in order to drive success of empowerment. The Flow Chart below depicts the increasing role for employees and decreasing role for supervisors in the decision making process in today’s context. Between years of 1990 – 1994, a self assessment was conducted and CTC identified the following lacunas such as lack of overall direction, lack of awareness on business issues, discontinued management team, departments functioning in isolation and in disciplined environment. After which the management identified Key initiatives and actions such as knowledge management, people involvement, culture change, gaining confidence of unions/employees and improvements in productivity via practicing concepts of Teamwork, industrial harmony etc. During the period 1995 – 1996 CTC focused on building Trust within the company employees by adapting Teamwork throughout the organization, extensive training for shop floor employees, common time entry system, common recreation facilities, common social events etc. During 1997, shared vision and mission with focus business strategy, re-engineered business processes, multidisciplinary cross functional project teams, extensive training and education, creation of a winning culture, industrial and non industrial benchmarking and focus on continuous improvement.

So in an emergency time it can be obtain from any branch of a particular hospital. Keyboard is also used to command for certain activity or works. Using keyboard we can input alphabet, numbers, punctuation etc†¦. to the computer. Keyboard is a device which is very similar to type writer. Keyboard can be divided into two types by the way the keys are arranged in a keyboard. Qwerty Keyboard Dvorak Keyboard In ENIAC computer punch card and In BINAC computer type writer are used instead of keyboard. The type of keyboard which is very commonly used is QWERTY keyboard. QWERTY keyboard are very similar to type writer. Keyboard is faster than pointing device to enter data or give command to the computer. Some of the important keys, Shift key Caps lock key Num lock key Space key If there is no keyboard there is an option to use keyboard as on-screen keyboard because keyboard is very important. But using on-screen keyboard is very slow while using because it is use by using a pointing device. Keyboard is one of the important devices so, I recommend QWERTY type keyboard which is commonly used by users. 02.1.2 Mouse Mouse is a primary input device. It is a kind of pointing devices. There are three types of mouse, Mechanical mouse Optomechanical mouse Optical mouse The movement of mouse can be recognised by the cursor on the screen. The use of mouse, Drag and drop files. Select items. Opening files by double clicking on the icon. Display command to do by right clicking on the icon. 02.1.2.1 Mechanical Mouse Mechanical mouse has a ball under it .Due to the mechanical sensor while the ball or mouse moves the cursor in the screen move in the same way as the mouse move. 02.1.2.2 Opto mechanical mouse Opto mechanical mouse is similar to mechanical mouse but instead of a ball an optical sensor is used to the motion of the cursor in the screen. 02.1.2.3 Optical mouse Laser technology is used to notice the movement of the cursor in the screen. Optical mouse Response much faster than mechanical and Opto mechanical mouse Mouse is an important input device. So, i recommend optical type mouse to the lion cab service which is faster than other type of mouse. 02.1.3 Scanner Scanner is an input device which is used to input text and other pictures into digital format. The main use of the scanner is to process images. There are two types of scanner, Flatbed scanner(also known as reflective scanner) Handheld scanner. Is Wal-mart Good for Overseas Workers? Essays -- supermarket industry,

When Wal-mart first entered the supermarket industry back in 1962, they were already off to a disadvantage as the industry during that time was already dominated by well-established and deeply experienced national chains such as Albertsons and Safeway. However, in a period of just ten years, Wal-mart had opened an average of seven supermarkets per month for 120 consecutive months, with a total of 888 supercenters. (Fisherman) By then, Wal-mart became the number one food retailer in the nation. What led Wal-mart from starting out as a rookie grocery market to becoming a dominating, world-wide supercenter? The answer is in their prices, which is generally 15 percent lower than their competitors’. (Fisherman) For this very reason, Wal-mart has changed the lives of many, including the spending habits of the shoppers and the working environments of the factory workers overseas who produces these low-priced products. Although Wal-mart’s slogan â€Å"Save money, live betterà ¢â‚¬  appeals to many of the customers, their actions are putting a burden on factory workers overseas as many are forced to work without the proper benefits and safety regulations. One of the many reasons why Wal-mart is able to manufacture cheap products is because of the ridiculously low wages and long hours given to the workers overseas. They receive little to no benefits, breaks, or vacations. Their working hours typically start before 8A.M. and lasts until 11P.M., seven days a week and they only have ten days off in a year (185). In â€Å"The Wal-mart effect† Robina Akther, a sixteen-year old sewing operator from a factory in Dhaka, discloses that she only earns 13 cents an hour for fourteen hours a day, which is about $26.98 a month (185). Akther also mentioned, â€Å"I clean ... ...e products. These injuries often go unreported since workers are afraid of being fired or punished, and they simply cannot afford to lose their jobs. Furthermore, most factory workers do not have the money to afford medical care and as a result, most do not treat their problems or go into debt trying to pay for medical attention. Once again, Wal-mart is shown to not care about workers’ safety, whether if it is providing them with insufficient safety equipment or blocking the fire escapes to prevent workers from taking breaks. One reason for this is the local labor laws that are unique to each country, such as the minimum wage and safety standards, allow factories to continue operation below the international standard. In addition, many factories operate under the table. Safety reports are faked or many things go unreported, and underage workers are allowed to work.

Therefore, one could say that much progress was made in the field of science in terms of understanding the functions of the human brain and some of its behavior. It seems that as each new day passes, something new is discovered about the brain, whether it be a new mental or physiological brain condition, or merely a link and clue to one of the vast number of questions the world has considering the human brain and behavior. These discoveries and answers are becoming more and more important and imperative due to the fact that the overall population seems to becoming more and more emotionally fragile and more subject to several cerebral ills such as depression, anxiety, hysteria, and clinical insanity. A good question to ask is whether or not the overall population seems to be suffering more mental and cerebral ills, or that it is merely a result of more cases being reported and more statistics calculated. But if it is true that the number of people suffering from conditions or types of behavior which hinder their ability to go on with their everyday lives, what is the cause? And when we find the cause, what is the cure? Or how will society as a whole handle it? A possible theory is to look at the correlation between the rate of growth and process in modern society and the stress level of the average individual. Another question to ask is what exactly is the role stress plays in an individ... ...raising the levels of anxiety and depression amongst the population. Perhaps evolution will take hold and those with brains and systems more well adapt to handling this relatively new level of stress will flourish, making our society stronger. Or it could have a reverse effect, making society weaker in the process. Hopefully stress and it's harmful effects will be brought to attention more by the scientific community and as a whole society will do something about it or risk suffering from the potential set backs. Lift the Trade Ban on Cuba Essay -- essays research papers

Unlock the Gate to Cuba In the long and turbulent history between Cuba and the United States, it can well be argued that Cuba did not turn out quite like its other Latin American peers. Things seemed to be on the right track in the early 1900’s, when it appeared that Cuba was destined for a future of â€Å"independence†, like its neighbour Puerto Rico and it was yet another South American nation rife with the now atypical blend of affluent American investors and poor workers usually native to the land herself. However, following a coup d’à ©tat that saw the fall of the American-backed Fulgencio Batista in favour of his social antithesis in communist Fidel Castro, the situation rapidly turned sour. The American government, finding themselves backed into a corner and unable to mold Cuba in its golden image, decided that it would be pertinent to sever all trade with Cuba. Since America’s policies towards Communism were clear, the trade embargo began to look like a more long-term intervention. To this day, the trade embargo is still in place, and it appears unlikely that this president, as well as many more from those who will succeed him, is ready to discuss any possible amendment. However, these economic sanctions have seen its efficacy come to an abrupt end. The ban on Cuban trade should be lifted in order to reduce poverty on the island, boost the economies of both the United States and Cuba, give America access to superior healthcare and allow America to acquire some cheap labour. In this essay, I will inform you of four things; (1) Cuba’s poverty caused by the sanctions, (2) how lifting the embargo would benefit Cuba, (3) how lifting the embargo would benefit America, (4) why continue the sanctions (5) how close are we to lifting the sanctions. Finally, It is clear that there is a serious issue regarding poverty in Cuba that directly results from the forty year old sanctions. It would benefit both countries to lift the sanctions in terms of trade, immigration and development. The sanctions have so far proven unsuccessful, and are just hindering the Cuban economy. Despite all of these points, it seems doubtful that the doors to Cuba shall be unlocked, and that the poverty and suffering could continue forever until we get another FDR-like president who has enough sense to change something. Blink †Malcom Gladwell Essay

Among the thought provoking topics Gladwell presents in Blink, I found slicing as one the most interesting. The idea that short snippets of information can potentially allow more accurate perceptions of people and situations than longer periods with in-depth study and exposure to information. The awareness of the unconscious realizations occurring much quicker and more accurately than cognitive thought, inspires additional pontificate on ways to cut through the noise that interferes with conscious thoughts. Additionally, his identification of potential noise spurs the mind to ignore the slices offer opportunities to understand potential causes for historical perceptions that have proven to be incorrect. While reading Gladwell’s elaboration on the various methods of slicing, several historical business decisions come to mind. Gladwell’s review of speed dating offers many similarities to my experiences interviewing candidates to fill vacant positions on various teams I ha ve managed. My process for interviewing candidates is a multistep process, where my first interview is normally no more than 30 minutes, containing about 15-20 minutes of my explaining the position being filled and the needs of the company. Gladwell specifically identified the purpose was not to determine if both speed dating parties want to establish a relationship together. The purpose was to decide if each person has enough interest in the other, to at least learn more about him/her. In the 10 minutes where I directly interview candidates for skills and competencies, I am simply deciding if I want to bring this person in to learn more detail about their skills and competencies. Gladwell also identifies that slicing is not always effective, due to noise received by the conscious self, sometimes allowing cognitive thought to challenge the unconscious perception. Although I take detailed notes on each candidate, there are many instances where, despite the notes and the observed mannerisms, my ‘gut’ suggested an opposite direction from the logical choice. In retrospect, I realize that during these initial interviews, as I put significant effort into evaluating skills and competencies as a whole. There was just too much data reviewed, instead of focussing on individual slices of data. In some cases my mind even justified the potential issues, offering undue credit to candidates because of their persuasive discussions and mannerisms, thereby continuing the hiring process with candidates that should not have made it past the first round. During one interview in particular, I was filling a position as Category Manager and my pool of candidates was somewhat limited. My company’s push to hire diversity candidates made the pool even shallower. After bringing candidates in for first round interviews, I decided to post the position online for a second time. The subsequent candidates were not significantly better than the first round. I could not identify a specific reason for my disinterest in the candidates, they just didn’t feel right. Most did not offer the typical image I associated with a successful category manager. As a favor to a colleague, I agreed to interview a wild card candidate for my vacancy. She had no experience with category management, but her career history showed steady progression and 3.8 GPA throughout her chemical Engineering major offered evidence of her intelligence. My colleague spoke very highly of her abilities and during the initial interview her image was consistent with high performing category managers I have known in the past. In reviewing my notes after the interview, I documented her lack of experien ce as being a key opportunity. Although my logical decision should have been to remove her from the list going forward, I followed my ‘gut’ and continued the interview process with her. As the process continued, she was eventually hired for the position on my team. I had somehow convinced myself that she could learn the trade and excel at it in a short period of time. Within a few months of hiring her, we both realized she wasn’t going to meet the requirements of the position and eventually, she went back to her previous company. I couldn’t help but wonder how she could have performed so well during the interview compared to the other candidates, but not be able to perform the duties of the actual job itself. After finishing Gladwell’s elaboration on priming, I gained better insights as to potential reasons why I hired the wrong person. Gladwell offered great examples of priming and how key words can impact an individual’s performance on tests. During the interview process, I normally discuss my educational and career history in an effort to reduce anxiety in candidates. I can’t help but wonder if during my discussions, I primed candidates, thereby pushing them to perform at anticipated levels based on my initial perception as they entered the first interview. Based on this theory, the words I chose during the interview process could have unintentionally encouraged one candidate and discouraged others. I find the concept of priming to be very thought provoking and it will definitely impact my speech at the beginning of each interview. Although Gladwell’s discussion regarding interpretations of slices of time proposes a more accurate perception is achieved by the unconscious mind well in advance of the conscious mind. Key points perceived during the initial moments could potentially shape my perception and thereby cause the subconscious to choose priming words to reinforce that perception. Being aware of this possibility is a key part of addressing it. From my experience illustrated above, focusing on neutral wording during future interviews will be a priority going forward.

Narrative of the Life of Frederick Douglass Essay

In the book, Narrative of the Life of Frederick Douglass, an American Slave, Douglass chronicles his slave life during the mid 1800s. By informing his readership of the realities and cruelties of slavery, Douglass’ seeks to persuade Northerners to become involved in the abolitionist movement. He accomplishes this purpose by delivering his message throughout the entirety of the book — slavery is harmful to all participants – with the effective utilization of ethos, logos, and pathos. The trio works to support his thesis, and this support therefore aids Douglass’ overall purpose. Although each of the argumentative devices is effective, the most powerful component is pathos, which is a quality that evokes pity or sadness. Unlike ethos or logos, pathos speaks directly to the readers, in this case the North, and profoundly influences their emotions and thoughts on the issue of slavery. Therefore, pathos is the most effective strategy in Douglass’ narrative because it accomplishes the author’s purpose by sufficiently delivering his message, through the manipulation of emotions to Northern readers. Ethos is without a doubt an apparent strategy throughout Douglass’ narrative; in fact, the entire book is ethos. Douglass’ life was, at the time, living proof of the cruelties of slavery. He takes advantage of this fact in his narrative and describes almost every detail, being sure to leave out names whom he did not intend to offend or embarrass, and brings to reality the treatment of slaves in the 1800s. In addition, Douglass incorporates references to the Bible, often relating slaves’ lives to peoples’ lives in Biblical times. For example, â€Å"My friend Nathan Johnson (of whom I can say with a grateful heart, ‘I was hungry, and he gave me meat; I was thirsty, and he gave me drink; I was a stranger, and he took me in’).† This is a reference to Matthew 25:35, which discusses the importance of caring for others, even strangers. Douglass includes this passage to compare Nathan Johnson to a humble, selfless man that would care for anyone. Furthermore, the reference supports Douglass’ credibility as an educated man of God and a reliable non-fiction author. Just because he was once a slave, ignorant of freedom and all its blessings, including education, it did not stop him from brilliantly writing his narrative through which he sufficiently proves his credibility by means of correct grammar, references to the Bible and other highly respected pieces of literature, and the simple fact that he was once a slave and therefore contains the most reliable information. However, ethos is not the most effective strategy on his readers; it does not support his purpose or meaning as much as pathos does. Logos is also a strategy used throughout the entirety of the book, simply because it is a narrative of Douglass’ life, therefore it must be composed of non-fiction occurrences. He includes as much detail as he can, but he leaves out particular names and happenings in order to prevent embarrassment of the individual or even potential consequences. Despite his restrictions, Douglass still includes amazing thoroughness and accuracy. For example, â€Å"I left Master Thomas’s house, and went to live with Mr. Covey, on the 1st of January, 1833.† He uses three specific details in one tiny sentence, which just shows the reader his incredible memory and accuracy. Although his precision within the book is rather impressive to the Northern readers, the simple facts do not supply them with Douglass’ deeper meaning, that slavery is harmful to all participants. Rather, logos gives the readers the direct happenings of his slave life, but it does not reach out to the Northerners’ emotions, humans’ weakness and main influence to take action, to the extent pathos does. Pathos is a strategy in argument that aims to draw pity or sadness from the audience or reader, and it is often the most persuasive tool to accomplish a purpose. In Narrative of the Life of Frederick Douglass, an American Slave, Douglass uses a generous amount of pathos in order to persuade his Northern readers to become involved in the abolitionist movement. He accomplishes this purpose by including sad incidences he saw or experienced himself. For example, Douglass tells the story of his Aunt Hester being punished with a whipping, â€Å"He commenced to lay on the heavy cowskin, and soon the warm, red blood†¦came dripping to the floor. I was so terrified†¦that I hid myself in a closet.† This description of the first time he saw someone whipped is drawn out in detail purposefully; Douglass wants the reader to engage in the narrative and let his/her emotions drive them toward pity for slaves and hatred of slavery. He includes many other descriptions like this, but they all have the same purpose. Emotion drives many peoples’ actions, and Douglass wants to persuade his Northern audience to become active in the abolitionist movement by letting their emotion take over. Pathos also brings out the meaning of the essay; by explaining cruel experiences, Douglass includes proof of his meaning, that slavery is harmful to both the slave and the slaveholder. Northerners are persuaded by this meaning and affected by the traumatic incidences in the book, and are driven to involve themselves in the move to abolish slavery. Pathos is therefore the most effective strategy that encourages Northern readers to follow through with Douglass’ purpose. Douglass utilizes ethos, logos, and pathos in a brilliant way, but it is acceptable to claim that pathos had the largest effect on the readers of the North in the 1800s. While ethos and logos give the author credibility and information to discuss, pathos affects the reader directly. It becomes tiresome to hear of straightforward facts, like moving from master to master or plantation to plantation. The readers want to hear of excitement, so when Douglass talks about sad topics, it involves the reader, as well as affects their opinion of slavery. By taking advantage of pathos and the readers’ impressionable emotions, Douglass conveys his message and fulfills his purpose, and therefore, pathos is the most effective strategy in his book. Factors influencing Comprehension The article under the sub- heading Understanding Comprehension stated that â€Å"comprehension is complex†. It is my belief that teachers whether in the primary or secondary system should see it as such and not just a situation where a passage is just read and the questions answered at the end of it. It has been brought to my attention that comprehension is affected by a variety of factors some of which may be considered internal as well as external. Some of the internal factors may include stressful situations and the external factors would include the reading text assigned and the pages with dense text with few paragraph breaks or illustrations. It is then my belief that if the pre-service and inservice teachers saw this as a critical issue then for those of us who have not been taking it as seriously then we need to. The students who we teach may have been affected by these factors but because of teachers ignorance comprehension lessons where not adequately prepared. Secondly, the fact that background knowledge was so important on the side of the pupil just did not occur to me. I thought that what I gave initially at the beginning of the lesson if they had no experience it would be enough. Students being taught the comprehension lesson should have some experiential background to the text being used or the teacher could run into problems. â€Å"Schema theory tells us that readers must have adequate back-ground knowledge to understand what they read; it also tells us that readers must activate their prior knowledge† (Langer, 1984). Preparations for students doing comprehension lessons must therefore be more in-depth not only on the teachers part but in light of the students as well as one needs to investigate if the students has any prior knowledge. Thirdly and quite interestingly the Transactional theory brought home the fact that different students read for different reasons, the efferent stance or the aesthetic stance. The fact is a student’s stance can influence his or her comprehension. In teaching we need to know just how important the material is to our students or rather how important we make it for them. The fact that they may be quizzed at the end of a reading may generate more interest. The students who read just for sheer experience may just not comprehend as well as the one who does it for a purpose that could be considered more important. Fourthly, comprehension as a process is very stimulating to a student or students for that matter. The fact that this process begins before actual reading and end long after the reading is finished emphasises the activities that are used to grab and keep the students involved in the whole teaching and learning experience. Dividing instruction into prereading, during reading and post reading helps teachers design activities for each stage that will improve students’ comprehension (Carlton, 1982) and provides opportunities for teachers to demonstrate strategies that readers can use at this stage†. The actual process of comprehension and the strategies used has truly been an experience and will be a welcomed difference in my approach to the teaching of comprehension.

Pros and Cons in Fox Hunting

In this paper I will discuss the issues surrounding foxhunting. I will mention the pros and the cons and then I will decide if fox hunting should be criminalized. I will begin with the pros. Just a little intro on foxhunting and what it is. In Britain mostly England foxhunting is a popular sport. Hunters set out on horse back following hounds witch are following the scent of foxes. When the hounds find the fox they rip it apart and the hunters watch this happen and then go off to find more foxes. The foxhunters generally wear coats of bright scarlet, called pinks. The members of the club support the hunt, and the Master of Fox Hounds (MFH) usually maintains it. Some of the pro points of fox hunting are, the fox is a pest and its population needs to be controlled. Farmers are concerned and agree with this. Responsible fox management includes maintaining a healthy population at a level, which it can grow without threatening livestock or other wildlife. Fox hunting is the most natural method of management: by its nature it takes out the old sick and injured foxes. Fox hunting does not just help control fox numbers, landowners with an interest in fox hunting plant and maintain coverts, woodlands and copses for the benefit of all wildlife. If it wasn't for fox hunting they would over populate and they would eventually have to be caught and be shot or gassed. Foxes cause significant lamb, piglets, and poultry losses. Scientific estimates vary from 0. 5% to 5. %; even at 2% the cost to a typical farmer with 1500 lambs and piglets is worth over $2200. Without control the percentage would increase considerably. If there was a ban on fox hunting 15,000 people whose jobs directly depended on fox hunting would be out of work, some 14,000 foxhounds would have no future, as these working pack hounds would not make suitable pets. The species is not endangered Now on to the cons of the subject, the official foxhunting season begins on November 1st and continues through April. Some hunts even go into May. Fox cubs are usually born in March, which means that a pregnant and nursing vixen (female fox) are hunted and killed by hounds. Incidents of vixens being killed and unborn cubs being scattered around by the hounds at a kill, these have been recorded on film. There are also several recorded instances of hounds attacking small pet dogs and cats which, although fatally savaged survived the initial attack, further evidence that the hounds do not kill their prey instantly. Generally people see it as a cruel blood sport that should be banned. Many have argued that if fox hunting is banned jobs will be lost, however this is unlikely to happen because labor and other resources associated with fox hunting would be reinvested in other enterprises and activities. Drag and bloodhound hunts represent a cruelty-free alternative to mounted fox hunting. Drag hunting involves riding horses across open country in pursuit of a scent left by a human, either running on foot or trailed on scented â€Å"drag† from a horse. Bloodhound hunts differ from drag hunts in that there are fewer hounds and the hounds chase a human quarry (e. . a local athlete), rather than dragged artificial scent. Because of this few, if any jobs would be lost if the people that were involved in fox hunting chose to participate in either of these activities. A ban would also increase the availability of resources previously used by hunting to other rural business. For example, horse stables could be converted to living accommodation or office space. Overall, it would appear that a ban on fox hunting is unlikely to have any significant negative effect on rural employment. Existing evidence suggests that many jobs will be saved or created by a switch to drag or bloodhound hunting, and by the growth of new activities. Now for my conclusion if fox hunting should be criminalized, both sides have good arguments but I am against foxhunting because there are other methods of getting rid of the fox. From the research I have done I noticed that the hunters don†t just go after the fox because there is too much of them, but they also get a rush out of it. That†s why there are drag hunting and bloodhound hunts. A survey was done by 1000 farmers and they found that support for fox and drag/bloodhound hunting was fairly similar. 56% of farmers would not allow drag/bloodhound hunting on their land, compared to 48% opposed to foxhunting. Based on these findings, the league against cruel sports extrapolated that as many as 60 000 farmers in the UK, covering up to 7. 5 million hectares of land, would allow drag hunts on their land. Jobs would not be lost because the people and the hounds can transfer to drag hunting. I believe that a ban on foxhunting would be beneficial toward the economy and a new era would begin.

The most obvious such explanation for the decisions referenced above is that the Supreme Court does not want to shackle government law enforcement efforts. Undoubtedly, that is a large part of the answer. But it is not the entire story. As I have suggested elsewhere n5 (and briefly explain again here), effective crime control and a more activist interpretation of the Fourth Amendment are not necessarily mutually exclusive. Other explanations for the Courts less-than-robust reading of the Fourth Amendment focus on the ironic consequences of decisions, mostly generated by [*605] the relatively liberal Warren Court, that were meant to expand its scope. For instance, it is fashionable to place much of the blame for todays law on the Warren Courts adoption of privacy as the core value protected by the Fourth Amendment. This move, in Katz v. United States, n6 was hailed at the time as a major enhancement of constitutional protection against government intrusion. As many have pointed out, however, because privacy is a manipulable concept, the Court has since found it easy to declare that a large array of police actions-ranging from use of informants to public surveillance and school and workplace drug testing-either do not implicate or are only limply protected by the Fourth Amendment. n7 This diagnosis has some attraction as well, but fails to explain why even the more liberal justices have often gone along with many of the privacy-diminishing holdings of the Court. In this essay, I too suggest that the modern Courts early expansive stances on the Fourth Amendment have ultimately led to its diminishment. But Katzs expectation-of-privacy formulation is not the culprit. Rather, three other liberal dogmas-what I call the probable-cause-forever position, the individualized suspicion mantra, and the obsession with exclusion as a remedy-are the primary reasons we have a Fourth Amendment Lite. The end-logic of these three dogmas produce such unappealing results that even moderate and liberal justices have balked at them, leaving us with a search and seizure jurisprudence that is much less than it could be. When a search requires probable cause to be constitutional, courts are naturally more reluctant to denominate every police attempt to find evidence a search. When suspicion must be individualized, they are more likely to gloss over the harms caused by investigations of groups. And when the sole serious sanction for an illegal search or seizure is suppression at trial, many judges have less sympathy for viable claims, because they cannot stomach dismissal of criminal charges against guilty people. I. Probable Cause Forever Of course, probable cause is not required for every police action that is called a search or seizure. Terry v. Ohio, n8 a Warren Court decision, stands for the proposition that both detentions short of arrest and patdowns of outer clothing are permissible on reasonable suspicion, which represents a certainty level somewhere below the even-chance threshold often associated with probable cause. The Terry Court was willing to relax Fourth Amendment strictures with respect to stops and frisks because the governments interest in effective crime prevention and [*606] detection on the streets justified the brief, though far from inconsiderable, intrusion upon the sanctity of the person that these actions occasion. n9 In the seizure context, the post-Warren Court has routinely relied on this balancing approach-or what I have called the proportionality principle-in holding that several different types of detentions short of an arrest may take place on less than probable cause. n10 In the search context, however, it has been much less willing to follow this route. Instead, the Court has insisted, in the words of Justice Stewart in Katz, that searches conducted . . . without prior approval by judge or magistrate [and therefore without probable cause], are per se unreasonable under the Fourth Amendment, subject only to a few specifically established and well- delineated exceptions. n11 †¦ [In] T. L. O. .. [the Court] then went on to hold that probable cause was not required to search a school childs purse for evidence of disciplinary infractions, thereby creating the one major exception (other than Terrys frisk rule) to the probable-cause-forever dogma. Labeled the special needs doctrine, a phrase taken from Justice Blackmuns concurrence in T. L. O. , the exception, when it applies, requires only that government action be reasonable, n14 which in practice has meant that neither a warrant nor probable cause is required. But the special needs exception is usually only applicable when, as in T. L. O. , those conducting the government action are not police and are pursuing some end other than ordinary criminal law enforcement (e. g. , school disciplinary searches, drug testing for administrative purposes, checkpoints for immigrants, or inspections of businesses for regulatory, health and safety violations). n15 Indeed, the classic statement of the special needs paradigm is that it kicks in only when special needs, beyond the normal need for law enforcement, make the warrant and probable-cause requirement impracticable. n16 The Court has on several occasions called these special needs [*607] situations exceptional and limited. n17 In other words, outside of frisks, the usual law enforcement search for evidence of criminal activity requires probable cause. n18
